Ohm Terms of Use

Last Updated: August 8, 2026 Applies to: Ohm for iOS, including beta versions distributed through Apple TestFlight.

These Terms of Use (“Terms”) are an agreement between you and Ohm LLC (“Ohm,” “we,” “us”). By installing or using Ohm, you agree to them. If you don’t agree, don’t use the app.

1. What Ohm Is

Ohm plays music from Apple Music based on your context. Ohm is not a music service: it does not host, stream, or license any music itself. All music comes from the Apple Music catalog and your Apple Music library, and your access to that music is governed entirely by your agreement with Apple.

2. Eligibility and Requirements

• You must be at least 13 years old (or the higher minimum age required in your country for the data processing described in our Privacy Policy).
• You need an active Apple Music subscription. Ohm does not function without one, and we are not responsible for interruptions caused by the state of your Apple Music account.
• You need a compatible iPhone and iOS version.

3. Beta Software

During the TestFlight period, Ohm is pre-release software. That means, concretely:

• Features may change, break, or disappear between builds, without notice.
• Recommendations are the product of a system that is still learning; expect misses.
• Your data, account, or learned recommendation state may be reset or deleted during the beta as we change the system. Do not treat anything in Ohm as permanent during this period.
• Your use of TestFlight itself is governed by Apple’s TestFlight terms, including Apple’s collection of crash logs and usage statistics you consent to when joining a beta.
• If you send us beta feedback — in the app, in interviews, in messages, or through the beta feedback program — you grant us a perpetual, irrevocable, royalty-free license to use that feedback to build and improve Ohm, without obligation or attribution. Feedback is input we weigh, not a commitment we make.

4. Your Account

You sign in with Sign in with Apple. You are responsible for maintaining control of your Apple ID and your device. You may delete your account at any time through the in-app deletion flow; deletion and the 30-day recovery window work as described in the Privacy Policy.

5. License to Use Ohm

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Ohm on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service Usage Rules (including access by other accounts associated with yours via Family Sharing or volume purchasing, where applicable). This license is for personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or lease any part of Ohm
• Reverse engineer or attempt to extract source code, models, or recommendation logic, except where the law permits it despite this restriction
• Use Ohm to circumvent Apple Music’s licensing or DRM
• Probe, scrape, overload, or interfere with our servers, or access them by any means other than the app
• Use Ohm in violation of any applicable law

6. Privacy

Our collection and use of your data is described in the Ohm Privacy Policy, which is part of these Terms. Read it: Ohm processes your listening history and contextual signals, and the policy states precisely what leaves your device and what never does.

7. Intellectual Property

Ohm — the app, its design, its recommendation system, and its name — is owned by us. Music, artwork, and related metadata belong to their respective rights holders and are provided through Apple Music. These Terms give you no rights in any of it beyond the license in Section 5.

8. Availability and Changes

Ohm depends on our servers and on Apple’s services. We may modify, suspend, or discontinue the app or any part of it at any time, and during the beta we will do so frequently. If a network failure or pool exhaustion means Ohm cannot make a confident recommendation, playback stops rather than playing something arbitrary; this is deliberate behavior, not a defect.

9. Termination

You may stop using Ohm and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we discontinue the service, or at the end of the beta period. On termination, your data is handled as described in the Privacy Policy.

10. Disclaimers

Ohm is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that Ohm will be uninterrupted, error-free, or that its recommendations will suit any moment. Nothing in these Terms excludes liability that cannot be excluded under applicable law, and nothing limits your statutory rights as a consumer.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of Ohm. Our total liability for all claims relating to Ohm is limited to the greater of the amount you paid us for Ohm in the twelve months before the claim (which, during the free beta, is zero) or USD 50.

12. Apple-Specific Terms

The following terms apply because Ohm is distributed through Apple’s App Store and TestFlight:

• Parties. These Terms are between you and us only, not Apple. Apple is not responsible for Ohm or its content.
• Maintenance and support. We, not Apple, are solely responsible for Ohm and for any maintenance and support. Apple has no obligation to furnish any maintenance or support for Ohm.
• Warranty. To the extent any warranty exists and is not disclaimed, we are solely responsible for it. If Ohm fails to conform to an applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Ohm.
• Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Ohm, including product liability claims, claims that Ohm fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy, or similar legislation.
• Intellectual property claims. In the event of a third-party claim that Ohm infringes that party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of the claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with applicable third-party terms when using Ohm — in particular, Apple’s Media Services Terms governing your Apple Music subscription.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce them against you.

13. Changes to These Terms

We may update these Terms, and during the beta we likely will. Material changes will be flagged in the app or by notification. Continued use after a change takes effect is acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Ghana, without regard to conflict-of-law rules, and disputes will be resolved in the courts of Ghana, except where mandatory consumer law in your country of residence provides otherwise.
